According to a recent notification from the Home Ministry, a person’s OCI registration can be cancelled if he or she is convicted of a serious crime or formally charged in significant legal cases.
The ministry has set two primary conditions for cancellation: if an OCI cardholder receives a prison sentence of two years or more, or if he or she is charged with an offence that attracts a sentence of seven years or more.
As per the authority conferred by clause (da) of section 7D of the Citizenship Act, 1955 (57 of 1955), the Central Government has declared that the registration of an Overseas Citizen of India (OCI) may be cancelled if the person is sentenced to a prison term of two years or more, or if he is charged with an offence which carries a potential imprisonment of seven years or more.
